Introduction

The Website Terms and Conditions set out below apply to your use of the South Yorkshire Local Heritage List Platform (LHLP) website. They should be read in conjunction with details provided on the site about how the website operates. You should also read our Privacy Policy.

By using the South Yorkshire LHLP website, you accept these terms and conditions in full. If you register to use the LHLP to submit any material to the website, we will ask you to expressly agree to these terms and conditions.

Copyright and related rights

All content, designs, text, graphics, software compilations and source codes on this website are the copyright of South Yorkshire LHLP and its content providers Exegesis Spatial Data Management.

Reproduction of part or all of the contents of this website in any form is prohibited other than for individual use only and may not be recopied and shared with a third party except as set out in User-submitted content, below. The permission to recopy by an individual does not allow for incorporation of material or any part of it in any work or publication, whether in hard copy, electronic, or any other form. Any other use of the website without prior written consent from South Yorkshire LHLP is strictly forbidden.

Trademarks

South Yorkshire LHLP and the South Yorkshire Archaeology Service logo, are trademarks of South Yorkshire Archaeology Service and may not be reproduced without the prior written consent of South Yorkshire Archaeology Service. Other organisation and company names referred to on this Site may be the trademarks of their respective owners as indicated.

Use of Website/ permissions

The South Yorkshire LHLP can be used by both unregistered users, who will be able to view website content, and registered users (see below), who will also be able to nominate assets, make comments and use the website forum.

The South Yorkshire LHLP website is provided for private and non-commercial use and for the exchange of lawful, relevant, fair and appropriate information, opinions and comment. Use of the website that is inconsistent with those stated purposes is strictly prohibited.

All users (registered and unregistered) may;

(a)         view pages from our website in a web browser;

(b)         download pages from our website for caching in a web browser;

(c)          print pages from our website for your own personal and non-commercial use;

South Yorkshire LHLP reserves the right to suspend or restrict access to our website, to areas of our website and/or to functionality upon our website. We may, for example, suspend access to the website [during server maintenance or when we update the website]. You must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on the website.

Mapping

South Yorkshire LHLP (as set up by South Yorkshire Archaeology Service and facilitated by Sheffield City Council) is licensed through the Public Sector Mapping Agreement for the use of Ordnance Survey mapping and data to provide context for its own business data and information.

You are granted a non-exclusive, royalty free, revocable licence solely to view the licensed data for non-commercial purposes for the period during which Sheffield City Council makes it available. You are not permitted to copy, sub-license, distribute, sell or otherwise make available the licensed data to third parties in any form. Third party rights to enforce the terms of this licence shall be reserved to OS.

Registration

In order to submit nominations, comment or use the website forum, you will be required to register with information about yourself (name, email address, username and display name). In doing so you agree to provide true, accurate, complete and current information, which you are required to maintain and update on your ‘User Info’ page.

Our use of Registration Data and certain other information about you is subject to the Privacy Policy.

The registration processes on this website will involve you choosing a unique username and password that gives you access to your website account. You are responsible for maintaining the confidentiality of your username and password, and are fully responsible for all activities that occur through your website account. You agree to (a) notify South Yorkshire LHLP immediately if you become aware of any unauthorised use of your password or website account or any other breach of security by sending an appropriately worded email to syorks.archservice@sheffield.gov.uk, and (b) ensure that you exit from your website account at the end of each session. South Yorkshire LHLP cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.

Limited Warranties

We do not warrant or represent:

(a)         the completeness or accuracy of the information published on the LHLP (in particular but without limiting the foregoing any listing information);

(b)         that the material on the website is up to date;

(c)          that the website will operate without fault; or

(d)         that the website or any service on the website will remain available.

The South Yorkshire LHLP, its contributors, officers and assessors shall not be liable for any loss or damages or expenses of any kind including without limitation compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property or claims by third parties howsoever arising in connection with the copying or use of any information or material contained in or referred to on this website or otherwise from the use of this website.

South Yorkshire LHLP is not responsible for the content of external websites that link to this website or which are linked from it. Please also refer to our Privacy Policy.

Amendments

South Yorkshire LHLP reserves the right to change or amend these Website Terms and Conditions without prior notice.

User submitted content

The submission of any text, images, audio, video or other content to this website grants to South Yorkshire LHLP a non-exclusive, royalty-free licence to publish and use that content (or any part of it, and as that content may be edited, cropped or otherwise modified by South Yorkshire LHLP, at South Yorkshire LHLP's discretion) on this website, in any media and at any time. You also agree that any user of this website may use such content in accordance with these Website Terms and Conditions.

You (or the copyright owner) remain the owner of copyright in any content and are free to republish it wherever you (or the owner) so wish, subject to any other restraints. 

Your content must not be illegal or unlawful, must not infringe any person's legal rights, and must not be capable of giving rise to legal action against any person (in each case in any jurisdiction and under any applicable law). You agree to indemnify South Yorkshire LHLP, its contributors, officers and assessors from any and all claims and liabilities (including legal fees) which arise from your statements, contributions or other submissions to this website, from any unauthorised use of material obtained from our website or otherwise from your breach of our Rules

(d)         place on this website any material (or use any user name) which is defamatory, abusive, discriminatory, threatening, harassing, harmful to children, obscene, offensive, inappropriate, or which applauds, encourages or entices abuse, discrimination or hate;

(e)         use this website to promote the sale of goods or services or any other commercial solicitations.

(f)          disclose information given to you in confidence or which, by its nature, is confidential.

(g)          place on this website any material which could constitute an incitement to commit a crime, instructions for the commission of a crime or the promotion of criminal activity, or upload links to unlawful material;

(k)          place on this website any material that authorises, enables or encourages the dissemination of any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;

Content modifications, objections, refusal, removal and/or editing of content

Users with Editor and Publisher permissions on the South Yorkshire LHLP may view or edit any contribution that you or anyone else makes to this website. In addition, South Yorkshire LHLP, and others that it designates, shall have the right (but not the obligation) at its sole discretion to refuse, remove or edit any content that is posted to, or available on, this website without the need to give any reasons for doing so.
